Terms of Service

1. Agreement
By accessing or using UserDispatch (“the Service”), operated by Kiruna Labs, Inc., you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2. Service Description
UserDispatch provides a feedback collection widget, admin dashboard, API, and MCP server for managing user feedback in web applications. The Service is currently in beta and offered free of charge during the early access period.
3. Accounts
You must sign in with a valid Google account to access the dashboard. You are responsible for maintaining the security of your account credentials and API keys. You must notify us immediately of any unauthorized access.
4. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or to collect data in violation of applicable laws.
- Attempt to gain unauthorized access to other accounts, systems, or data.
- Submit malicious content, malware, or spam through the feedback widget.
- Reverse engineer, decompile, or attempt to extract the source code of the Service.
- Exceed reasonable usage limits or abuse the API in a way that degrades the Service for others.
5. Data Ownership
You retain ownership of all feedback data collected through the Service. We claim no intellectual property rights over your content. You grant us a limited license to process and store your data solely to provide the Service.
6. Service Availability
The Service is provided on a beta basis. We make no guarantees regarding uptime, availability, or data preservation. We may modify, suspend, or discontinue the Service at any time with reasonable notice. We will make commercially reasonable efforts to preserve your data and provide export options before any discontinuation.
7. Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. KIRUNA LABS DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, KIRUNA LABS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR FIFTY US DOLLARS ($50), WHICHEVER IS GREATER.
9. Indemnification
You agree to indemnify, defend, and hold harmless Kiruna Labs, Inc., its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or relating to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights, including privacy rights; or (d) any data collected through the Service by you or your end users in violation of applicable law.
10. Intellectual Property
The UserDispatch name, logo, and all related trademarks, service marks, and trade dress are the property of Kiruna Labs, Inc. The Service’s source code, design, and documentation are protected by copyright and other intellectual property laws. Nothing in these Terms grants you any right to use the UserDispatch brand or trademarks without our prior written consent.
11. Termination
Either party may terminate the agreement at any time. You may delete your account through the dashboard. We may suspend or terminate your access if you violate these Terms. Upon termination, your right to use the Service ceases immediately.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict-of-law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the federal or state courts located in Delaware, and you consent to personal jurisdiction in those courts.
13. Dispute Resolution
Before filing any legal claim, you agree to attempt to resolve the dispute informally by contacting us at hello@kiruna.ai. If the dispute is not resolved within 30 days, either party may proceed to binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration shall be conducted in English and held in Delaware or remotely at the arbitrator’s discretion.
The arbitrator’s decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction. Each party shall bear its own costs.
Small claims exception: Either party may bring an individual action in small claims court instead of arbitration if the claim qualifies.
Class action waiver: All claims must be brought in the parties’ individual capacity, not as a plaintiff or class member in any purported class, collective, or representative proceeding. The arbitrator may not consolidate more than one party’s claims.
14. Children
The Service is not directed to children under the age of 13. You may not use the Service if you are under 13 years old.
15. Severability & Entire Agreement
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Kiruna Labs regarding the Service and supersede all prior agreements and understandings.
16. Changes to Terms
We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the new Terms. We will notify you of material changes by posting the updated Terms on this page.
